Salary Range for this position is:

$32.74 - $48.85 Hourly
$2,619.23 - $3,908.31 Biweekly
$5,675.00 - $8,468.00 Monthly
$68,100.00 - $101,616.00 Annually

The Appeals work unit exists to: (1) analyze, review, and process any interested partys appeal of Department determinations of paid family and medical leave benefits, among other appeal hearings within the FAMLI program; (2) conduct administrative proceedings by holding hearings, resolving motions, and issuing timely written decisions consistent with due process requirements, statutes, regulations and case law governing the benefits provided under the
FAMLI program (C.R.S. 8-13.3-501 et seq.); (3) assist parties and members of the public who need assistance regarding the appeals process; (4) record and retain decisions of hearing officers; and (5) process appeals that have been remanded to the Appeals Unit for a new or continued hearing or issuance of a new hearing officers decision.

The Hearing Officer II serves as a neutral decision-maker to conduct hearings and adjudicate appeals of Department determinations of paid family and medical leave benefits, among other appeals filed under the FAMLI statutes. The hearing officer focuses on the issues appealed, holds status conferences with the parties if necessary, and explains the issues and the procedures to be followed for the appeal. The Hearing Officer II conducts fair hearings by allowing interested parties to provide sworn testimony and any other evidence relevant to the issues on appeal. When it becomes necessary to create a proper record or clarify an issue, the Hearing Officer II questions the parties and witnesses. After all the parties finish offering testimony and other evidence, the Hearing Officer II issues a decision on the pending appeal. Final decisions of the Hearing Officer II are appealable to the state district court. A Hearing Officer II may also send a matter back to the FAMLI Division administrators for further action.

MINIMUM QUALIFICATIONS:


Substitutions:

Additional appropriate experience will substitute for the degree requirement on a year-for-year basis.

Additional appropriate education will substitute for the required experience on a year-for-year basis.

Education and Experience:

Bachelor's degree from an accredited institution in a field of study related to the work assignment.

AND

Three years of professional experience in an occupational field related to the work assigned to the position.

Preferred Qualifications:

  • At least two years experience serving as an administrative hearing officer, trial judge, and/or substantial experience litigating cases or claims in specifically identified federal, state, or local government administrative agencies.

  • At least two years experience providing legal advice as an attorney on work focused on employment wages, benefits, and/or rights.

  • At least seven years experience litigating civil or administrative cases, claims and/or penalties before administrative or judicial adjudicatory bodies.
  • Bilingual (read, write, speak) in English and Spanish.
  • Previous experience performing alike duties as a State of Colorado classified employee.

Required Competencies:

Excellent legal writing and drafting skills, attention to detail, legal analysis, critical thinking and analysis, research, relationship management, exceptional verbal communications and presentations skills, managing multiple tasks and priorities, compliance and data / metrics orientation, demonstrated ability to manage performance metrics.

Conditions of Employment:
